Section 7:13-7.41 - Permit-by-rule 41-placement of a guiderail along a lawfully existing public roadway

(a) Permit-by-rule 41 authorizes the placement of a guiderail adjacent to a lawfully existing public roadway, provided the conditions at N.J.A.C. 7:13-6.7 are met and:
1. The installation of the guiderail is
required and overseen by the public entity having jurisdiction over the
roadway;
2. No riparian zone
vegetation is cleared, cut, and/or removed, except for vegetation within four
feet of the guiderail, where such disturbance is necessary to comply with all
State or Federal laws, requirements, or guidelines governing the placement,
maintenance, and functionality of guiderails; and
3. No trees are cleared, cut, and/or removed
in a riparian zone within 25 feet of any top of bank, unless the project lies
adjacent to a lawfully existing bulkhead, retaining wall, or revetment along a
tidal water or impounded fluvial water.
