Section 7:12-8.5 - Requirement to tag containers of shellfish

(a) A shellfish license holder harvesting shellfish shall affix to each container of shellfish at the harvest location a pre-printed tag with the information required at (b) below. The tag shall remain affixed to the container during transport to the certified dealer. Shellfish harvested on different dates or from different harvest locations shall not be commingled in a single container with a single tag.
(b) The pre-printed harvester tag shall be at least 13.8 square inches in size, durable, waterproof, and list the following information in order:
(c) If the shellfish is removed from the original tagged container, a tag that meets the requirements at (b) above shall be affixed to the new container.
(d) When shellfish are harvested from one harvest location on a single day by a single shellfish license holder, the shellfish license holder may use a single tag, referred to as a bulk tag, on multiple containers on a wrapped pallet, in a tote, in a net brailer, in a single boat, vehicle, conveyance, or other container, provided the bulk tag meets the requirements of (b) above, and, in addition, includes the number of individual containers under the bulk tag or an estimate of the total weight, volume, or count, as well as the following statement: "All shellfish under this bulk tag have the same harvest date and harvest location."
(e) If shellfish are sold in bulk, the shellfish license holder shall provide a transaction record to the certified dealer prior to transport. This transaction record shall contain all the information required at (b) and (d) above with the addition of the name of the certified dealer.
