Section 6A:27-9.13 - Renewing contracts

(a) Annual extensions of an existing contract, approved by the executive county superintendent, shall be permitted provided:

1. The contract was entered into through competitive bidding;

2. The terms of the contract remain the same;

3. There is no increase in the annual amount of the contract to the district board of education, or the increase in the contractual base amount as a result of such extension does not result in an effective increase that exceeds for the school year the annual rise in the Consumer Price Index (CPI) as defined in 18A:7F-45, regardless of whether the route description has changed or an aide has been added or removed. The increase may exceed the rise in the CPI when the increase, as provided for in the original bid, is directly attributable to the addition of an aide, a route change to accommodate a new student rider, or safety concerns. Any such extension shall require the approval of the executive county superintendent.
i. The contractual base amount is the sum of the actual cost to the district board of education for items included in the bid at the end of the term of the contract in the prior year; and

4. The school destination remains the same as the original contract.
i. Destination is defined as the physical location of the school(s).

(b) When it is necessary to change the bus type, an immediate rebid of a contract renewal shall not be required. Any such change shall be approved by the district board of education and shall be bid for the next school year.
