Subchapter 3 - PHYSICAL PLANT FOR NEW CONSTRUCTION, RENOVATIONS, AND ADDITIONS
Section 5:27A-3.1 - Scope

(a) The rules set forth in this subchapter shall apply to new construction, and to renovations and additions that are subject to the rules of new construction pursuant to (c) below.
(b) New construction, additions, alterations, or renovations of residential health care facilities shall comply with the New Jersey Uniform Construction Code N.J.A.C. 5:23 (N.J.U.C.C.).
1. New construction shall
comply with N.J.A.C. 5:23-3.
2.
Repairs, renovations, alterations, and reconstruction of existing residential
health care facilities shall comply with N.J.A.C. 5:23-6, Rehabilitation
Subcode.
(c) Requests for variations and waivers of physical plant standards may be submitted as follows:
1. A request for a variation of the
requirements of the N.J.U.C.C. shall be submitted to the New Jersey Department
of Community Affairs, Health Care Plan Review Unit, for review and
approval.
2. A request for a waiver
of any physical environment standard contained in this chapter, if compliance
with same would create a financial hardship, shall be submitted to the
Supervisor of Enforcement for the Residential Health Care Evaluation Program of
the Department and shall be reviewed in accordance with
N.J.A.C.
5:27A-2.6.
