Section 3A:55-1.2 - Definition and types of children's residential facilities

(a) "Residential child care facility" or "residential facility" or "facility" means any public or private establishment that provides room, board, care and treatment services for 13 or more children on a 24-hour-a-day basis.

(b) Residential child care facilities that are subject to the provisions of this chapter include:

1. Department-contracted or Department-operated residential child care facilities that serve children with emotional or behavioral problems and provide on-grounds educational programming;

2. Department-contracted or Department-operated residential child care facilities that serve children with emotional or behavioral problems who attend schools in the community; and

3. Department-contracted residential child care facilities that provide:
i. Drug and alcohol treatment services;

ii. Psychiatric services;

iii. Services to children with physical disabilities; or

iv. Adventure programs that serve children with emotional or behavioral problems.
