(a) Any adoption agency whose principal office is located outside of this State shall be licensed, certified, or otherwise legally permitted to operate in the state or country where the agency's principal office is located as a condition of applying for, securing, and maintaining a certificate of approval in New Jersey.
(b) No certified adoption agency shall discriminate with regard to the provision of any adoption-related services on the basis of age, religion, marital status, civil union or employment status with regard to the selection of adoptive parents for any child. However, these factors may be considered, pursuant to N.J.S.A. 9:3-40, in determining whether the best interests of a child would be served by a particular placement for adoption or by finalization of an adoption.
(c) No certified adoption agency shall deny to any person the opportunity to become an adoptive or foster parent on the basis of the race, color, or national origin of the child involved; or delay or deny the placement of a child for adoption or into foster care, or otherwise discriminate in making a placement decision on the basis of the race, color, or national origin of the adoptive or foster parent or the child involved.
(d) Each adoption agency shall have a written non-discrimination policy in accordance with (b) and (c) above.
