CHAPTER HISTORICAL NOTE:
Chapter 196,
Determination of Eligibility for Functional Services from the Division of the
Children's System of Care, was adopted as special adopted new rules and concurrent
proposed readoption of special new rules by R.2013 d.009, effective December 12,
2013 (operative January 1, 2013). See: 45 N.J.R. 53(a). Chapter 196, Determination
of Eligibility for Functional Services from the Division of the Children's System of
Care, expired on December 26, 2013.
Chapter 196, Determination of
Eligibility for Functional Services from the Division of the Children's System of
Care, was adopted as new rules and renamed Determination of Eligibility for
Functional Services from the Division of Children's System of Care by R.2014 d.026,
effective January 21, 2014. See: 45 N.J.R. 53(a), 46 N.J.R. 222(b).
Chapter 40, Determination of Eligibility for Functional Services from the Division
of Children's System of Care, was recodified from N.J.A.C. 10:196, Determination of
Eligibility for Functional Services from the Division of Children's System of Care,
by administrative change, effective January 3, 2017. As part of the recodification,
attendant technical changes were made to the rule text concerning cross-references,
agency names, addresses, etc. See: 49 N.J.R. 98(a).
In accordance with
N.J.S.A.
52:14B-5.1, Chapter 40, Determination of
Eligibility for Functional Services from the Division of Children's System of Care,
was scheduled to expire on January 21, 2021. Pursuant to Executive Order Nos. 127
(2020) and 244 (2021) and
P.L.
2021, c. 103, any chapter of
the New Jersey Administrative Code that would otherwise have expired during the
Public Health Emergency originally declared in Executive Order No. 103 (2020) is
extended through January 1, 2022. Chapter 40, Determination of Eligibility for
Functional Services from the Division of Children's System of Care, was readopted,
effective December 1, 2021. See: Source and Effective
