Section 2:8-6.7 - Exceptions

(a) Exceptions to the standards set forth in this subchapter may be made for small ruminants provided the practices meet one or more of the following conditions:
1. Small ruminants are under the direct care of a
veterinarian who can provide a medically supportable written explanation for the
conditions;
2. Small ruminants may be
confined in a vehicle or vessel for up to 28 consecutive hours without unloading for
feeding and watering in accordance with
49 U.S.C. §
80502.
i. For
purposes of determining this period of confinement, time spent in loading and
unloading is not included; and/or
3. Small ruminants may be confined in holding
cages or pens where feed may be withheld for up to 24 hours in accordance with
9 CFR §
313.2.
i. For
purposes of determining this period of confinement, time spent in a vehicle or
vessel shall not be included.
4. Exception to transport requirements:
i. Sheep may be confined for an additional eight
consecutive hours without being unloaded when the 28-hour period of confinement ends
at night in accordance with
49 U.S.C. §
80502.
