Section 2:76-3.11 - Withdrawal

(a) Under provisions of 4:1C-30, withdrawal of land from a farmland preservation program prior to its termination date may occur in the case of death or incapacitating illness of the owner or other serious hardship or bankruptcy, following a public hearing conducted pursuant to the "Open Public Meetings Act", 10:4-6 et seq., and approved by the board.

(b) The board shall document this approval by resolution and shall file a copy with the following:

1. Soil conservation district;

2. County clerk;

3. Municipal tax assessor;

4. Landowner;

5. Committee;

6. County planning board;

7. County governing body;

8. Municipal governing body;

9. Municipal planning board.
