Section 17:2-8.15 - Options at retirement

(a) A member of the Prosecutors Part shall, on the retirement application, select one of the nine options to receive retirement benefits as provided at 43:15A-50 and 17:2-6.1.

(b) P.L. 2001, c. 366 does not provide for a separate surviving spouse benefit. Members may elect survivor benefits under the provisions of 43:15A-50 and N.J.A.C. 17:2-6.1.

(c) A member of the Prosecutors Part who files for a retirement allowance from both the Prosecutors Part as well as the regular PERS, may select a different option and/or beneficiary under each retirement allowance.

(d) The cost-of-living adjustment as provided for in 43:3B-1 et seq. shall be calculated separately using the retirement date for each retirement allowance.
