(a) A clearance of not less than 26 inches shall be provided between seats, measured at the seat line from the front of the backrest of each seat to the nearest forward obstruction.

(b) A transverse and longitudinal seat space of not less than 16 inches shall be provided for each seated passenger.

(c) The seating capacity or seat layout in any autobus shall not be permanently changed without notification to the New Jersey Motor Vehicle Commission and no autobus in which such changes have been made shall be placed in service until inspected and approved by a representative of the New Jersey Motor Vehicle Commission.

(d) Seats are prohibited to the right of the driver except as otherwise provided in (e) below.

(e) A tour guide seat may be installed to the right of the center aisle, provided that such seat shall not be occupied by a person other than an employee of the autobus company. The seat shall be permanently installed. When the tour guide seat is not in use, it shall automatically fold to allow a clear 24-inch passageway. The tour guide seat shall be forward-facing and shall be equipped with a seat belt. The tour guide seat shall conform to 49 CFR § 393.90, incorporated herein by reference, as amended and supplemented.

(f) Seats shall be of substantial construction and securely mounted to the floor and/or sides.

(g) Wheelchair positions may be rear or forward-facing. Wheelchair positions in autobuses that are used to transport students to or from school or school-connected activities shall be forward-facing. Wheelchair positions shall conform to Federal Motor Vehicle Safety Standard No. 208, 209 and 210 ( 49 CFR § 571.208, § 571.209 and § 571.210 ), incorporated herein by reference, as amended and supplemented.
