Section 16:47-8.2 - Letter of No Interest

(a) A lot or site owner may request, in writing, that the Department issue a Letter of No Interest. The request shall be sent to the following:

1. Requests for issuance of such a letter
shall include a plan showing existing conditions and a proposed site plan, both
of which indicate size and type of land use; a copy of the municipal tax map
showing the lot or site in question and the adjacent lots on either side; and
the lot conformance calculations as described in
N.J.A.C.
16:47-5.1.
2. Requests shall explain why the owner
believes that his or her plans for development of the lot or site do not
require issuance of a permit and shall specifically set forth why the owner
believes that the development plans do not include any of the activities
requiring issuance of a permit set forth above.
(b) The Department will respond to a request for a Letter of No Interest within 60 days by issuing a final agency decision on the need for an access permit.
