Section 13:85-6.3 - Denial of application for rider coach certification; recertification; Notice of Invalid Certification

(a) The Chief Administrator's denial of an application for certification or recertification or Notice of Invalid Certification shall be in writing and shall specify the requirements for certification that the applicant or rider coach fails to meet and, in the case of a rider coach, the date on which certification became invalid. The denial or Notice shall specify the earliest date on which the applicant or rider coach may submit an application for certification or recertification, as the case may be.

(b) The applicant or rider coach shall have 25 days from the date of receipt of the denial or Notice of Invalid Certification to dispute any motor vehicle, judicial, MSF, Motor Vehicle Commission or other agency record the Chief Administrator relied on in the issuance of the denial or Notice of Invalid Certification. If no timely response is received, the denial or Notice of Invalid Certification shall constitute the Chief Administrator's final decision.

(c) If a timely response is received that does not dispute any record the Chief Administrator relied on in the issuance of the denial or Notice of Invalid Certification, the Chief Administrator shall consider any other argument raised in the response and determine the matter on the written record. The Chief Administrator's determination shall constitute a final decision.

(d) The applicant's or rider coach's written response shall be submitted to the Motor Vehicle Commission at the address set forth in 13:85-1.3(g) and shall be in an envelope marked "Response to Chief Administrator's Notice."

(e) The Chief Administrator may issue a Notice of Invalid Certification at any time in accordance with the procedures of this section.
