Section 13:85-5.4 - Facilities and equipment

(a) A provider's facilities and equipment shall conform to the standards established by the Motorcycle Safety Foundation and the Motor Vehicle Commission, and shall meet all applicable local and State zoning, building, fire, health and safety regulations. The following standards concern classrooms and ranges:

1. A classroom used to provide the MSE course shall:
i. Provide a minimum per participant space of at least 15 square feet and be large enough to accommodate at least 12 participants and their rider coaches, be adequately lighted, heated and ventilated, and not be used to store motorcycles, oil or gasoline or to repair equipment;

ii. Be equipped with desks or tables, electrical outlets, and a blackboard or similar device; and

iii. Be within a reasonable distance from bathroom facilities that accommodate both sexes.

2. A range used to conduct MSE courses shall be:
i. Of a size and construction that conforms to MSF standards and requirements;

ii. Within a reasonable distance from restroom facilities; and

iii. Capable of being closed to other traffic and pedestrians.

3. Use of a portable outdoor restroom facility to accommodate participants on a range is permissible provided it conforms to any applicable statute, regulation, or ordinance.

4. Any helmet, eye protection or motorcycle supplied to a participant shall be of a type in conformance with this chapter.

(b) The provider shall supply all materials, supplies, and equipment as required by MSF standards and requirements and any additional materials, supplies, and equipment as determined by the Chief Administrator and/or local authorities.

(c) The provider is responsible for security and maintenance of all materials, records, supplies and equipment and for loss or damage not covered under 13:85-5.2.
