Section 13:85-2.3 - Basic Skills Level course

(a) To participate in the Basic Skills Level course, Scooter BRC, or Three-Wheel BRC a person shall:

1. Have in his or her possession during each day of course instruction and available for display a Drivers License or Motorcycle Learners Permit that is not suspended, revoked, or expired, or a motorcycle license or endorsement, which is not suspended, revoked, or expired;

2. Have the physical ability to operate the controls of a motorcycle, scooter, and/or three-wheel vehicle, as the circumstances warrant;

3. Have the ability to balance a two-wheeled vehicle, when applicable; and

4. Wear the protective gear required by 13:85-2.2(a).

(b) A participant in the Basic Skills Level course shall receive all range training and instruction on a motorcycle manufactured for highway use that meets two of the following three criteria (as published by the original equipment manufacturer/distributor):

1. An engine displacement of 500 cubic centimeters or less;

2. An unladen weight of 400 pounds or less; and/or

3. A seat height of 30 inches or less.

(c) Motorcycles that have been modified or have had aftermarket equipment added to meet the criteria set forth in (b) above are not permitted to be used as training motorcycles.

(d) The criteria set forth in (b) above do not apply to a student-owned motorcycle when used by that student or to participants in the Basic Skills Level course provided by a United States military installation located in this State.

(e) Motorcycles that are used as training motorcycles shall be in safe operating condition.
