Section 13:74-5.12 - Hearing requirement and procedure

(a) Pursuant to the Administrative Procedure Act, 52:14B-1 et seq. and 52:14F-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1, the Commission may directly conduct a hearing to determine if a violation of its rules has occurred. Upon a finding of violation(s), the Commission may directly impose any of the penalties set forth in 13:71-5.10. Alternatively, the Commission may refer the matter to the Office of Administrative Law for a recommended decision.

(b) The licensee shall be responsible for any costs incurred in connection with any hearing held pursuant to this section.
