Section 13:71-21.8 - Deductions from winnings

(a) All purses contested for shall be distributed according to the conditions of the race. Deductions from the purse, either voluntary or involuntary, shall be made only as set forth herein. Deductions shall be made for payment to the owners and to collect the amount calculated by the New Jersey Horse Racing Injury Compensation Board, which shall not exceed three percent of gross overnight purses paid to owners, as assessments for the cost of workers' compensation insurance coverage pursuant to 13:71-6.31 and the rules of the New Jersey Horse Racing Injury Compensation Board set forth at N.J.A.C. 13:73. Deductions from purses may also be made to pay the organization and promotion expenses stipulated for stake and futurities.
(b) Five percent of the owners' payment shall be deducted and paid to the driver, and five percent of the owners' payment shall be deducted and paid to the trainer. In instances where the trainer is employed by a training stable, the payment shall be made to the training stable.
