Section 13:2-23.15 - Possession of container mislabeled as to fill prohibited; exception

(a) No licensee shall knowingly display, sell, or deliver any alcoholic beverage in an original container having a content of fill less than that stated on the container or label thereof, subject to such tolerance as permitted by Federal law and regulation; and no licensee shall possess such a container except for the sole purpose of return for credit or replacement consistent with 13:2-23.11 and 39.1.

(b) No licensee shall knowingly display, sell, or deliver any alcoholic beverage in an original container that has been married with another bottle of the same brand. "Marrying" is the industry practice that generally consists of pouring the contents of a larger bottle of alcohol, into a smaller bottle of the same alcohol.
