(a) Where the covered employer does not record hours worked for a particular employee because the employee is an exempt employee under the Federal Fair Labor Standards Act, 29 U.S.C. §§ 201 et seq., or the New Jersey Wage and Hour Law, N.J.S.A. 34:11-56a et seq., the employer may either:
(b) Where a particular employee is not an exempt employee under the Federal Fair Labor Standards Act, 29 U.S.C. §§ 201 et seq., or the New Jersey Wage and Hour Law, N.J.S.A. 34:11-56aet seq., when completing the Annual Equal Pay Report for Qualifying Services, the covered employer shall report the actual number of hours worked annually by that employee.
