Section 11:23-5.10 - Civil penalties

The Commissioner may, upon notice and hearing, assess a civil administrative penalty in an amount not less than $ 250.00 nor more than $ 5,000 for each day that a third party billing service is in violation of the Act. A penalty imposed by the Commissioner pursuant to this section may be in lieu of, or in addition to, suspension or revocation of a certification pursuant to the Act. A penalty may be recovered in a summary proceeding pursuant to the "Penalty Enforcement Law of 1999," P.L. 1999, c. 274 (2A:58-10 et seq.).
