(a) Failure to comply with any of the requirements of this subchapter shall be a violation of P.L. 2001, c. 225 (17B:27A-25.1 et seq.). If the Commissioner, after notice and a hearing pursuant to the Administrative Procedure Act, 52:14B-1 et seq., finds that such a violation exists, the premium reduction permitted by 17B:27A-25 shall not be applied, and the undiscounted applicable SEH rate shall be applied retroactive to the effective date of the discount.
