Section 11:21-21.4 - Eligibility requirements

(a) No purchasing alliance shall use as a basis for exclusion from membership in the alliance any of the following characteristics of any small employer group as a whole, or any person eligible for coverage in that group:
1. Health status;
2. Medical condition, including both physical
and mental illness;
3. Claims
experience;
4. Receipt of health
care;
5. Medical history;
6. Genetic information;
7. Evidence of insurability, including
conditions arising out of acts of domestic violence;
8. Partial or total disability;
9. Group size;
10. Age;
11. Gender; or
12. Any other health status-related
factor.
(b) A purchasing alliance shall not inquire as to the insured or uninsured health care claims experience or cost of any employer or employee.
