Section 11:2-3.8 - Credit accident and health insurance in connection with leases of personal property

(a) Insurers shall provide prominent written notice at the time of application that credit accident and health insurance coverage is not required. Such notice shall contain a date and signature section to be completed by the applicant. The form of notice shall be submitted to the Commissioner for approval with the credit accident and health insurance forms and a statement of the manner in which the notice will be provided to applicants.

(b) If a lease is terminated prior to its scheduled termination date, any credit accident and health insurance payments arising out of a disability which commenced prior to such early termination shall be paid by the insurer upon the continuing disability of the lessee as if the lease had not been terminated. Such payments shall be made directly to the lessee or other secondary beneficiary.
