Section 10:47-5.2 - Personal funds

(a) The facility shall establish and maintain a system that:
1. Assures a detailed accounting of each
individual's personal funds entrusted to the facility on behalf of
individuals;
2. Precludes any
commingling of individual's funds with facility funds or that of any other
person; and
3. Assures that the
individual's financial records are available on request to the individual,
parents and/or legal guardian.
(b) The facility shall develop a policy that permits and encourages the possession and use of money by individuals who are determined capable by the interdisciplinary team.
1. The facility shall provide training in the
use of money to individuals in accordance with their needs and abilities, and
establish the amount of money an individual may possess in accordance with
their needs and abilities which then shall be recorded in the Individual
Habilitation Plan.
