Section 10:46-5.1 - Appeals

(a) If the individual is determined by the Division not to meet the criteria for eligibility, the Division shall notify the individual in writing within 10 working days of the determination.
1. The
notice shall include specific criteria that were not met by the
individual.
2. The notice shall
include information regarding the individual's right to appeal the
determination of ineligibility pursuant to N.J.A.C. 10:48. Such appeals shall
be deemed to be contested matters.
3. The individual shall bear the burden of
proof and the burden of persuasion.
