(a) Application for eligibility to receive Division services at the age of 21 under this chapter may be made by the following individuals:
1. An individual 18
years of age or older may apply on his or her own behalf;
2. The guardian of an individual 18 years of
age or older; or
3. A court of
competent jurisdiction may apply on behalf of an individual 18 years of age of
older, who appears to have a developmental disability.
(b) Pursuant to N.J.S.A. 30:4C-4.4( P.L. 2012, c. 16, sec. 158) , the Division may continue to provide services to certain individuals under age 21 whom it is serving on January 22, 2013.
(c) Eligibility for services from any other State agency, including but not limited to, the Department of Health, the Department of Children and Families, or a local education authority, does not create a presumption of eligibility for Division services.
