DOH , when it determines that the health, safety, or welfare of the consumers warrant it, may immediately suspend the license of a PA, and take the necessary action to ensure the well-being of consumers. The PA shall have the right to make a written request to the DOH Commissioner for a review of an emergency license suspension. The DOH Commissioner, or designee, shall review this request on an expedited basis. The PA shall have the right to appeal the DOH Commissioner's decision by requesting an administrative hearing pursuant to the Administrative Procedure Act, N.J.S.A. 52:14B-1 et seq., and 52:14F-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1.
