(a) Notice of a proposed enforcement action shall be afforded to a facility pursuant to 10:161B-2.15.

(b) A facility shall have 30 days following receipt of a notice to request a hearing to appeal the action(s) specified in the notice.

(c) DOH shall transmit the hearing request to the New Jersey Office of Administrative Law (OAL) within seven working days of receipt.

(d) Hearings shall be conducted pursuant to the Administrative Procedure Act, 52:14B-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1.1.
