Section 10:123-2.2 - Authority

(a) All provisions of this subchapter, unless otherwise expressly noted, were adopted pursuant to authority of Section 3 of P.L. 1973, c. 256 (44:7-87 ) and Title 30 of the Revised Statutes as amended and supplemented by the Rooming and Boarding House Act of 1979 ( P.L. 1979, c. 496).

(b) The Commissioner of the Department of Human Services hereby authorizes and directs the Division of Family Development to act on behalf of the Department with all the authority thereof, as the official designated lead agency in taking the necessary and appropriate action in accord with the provisions of Section 3 of P.L. 1973, c. 256 (44:7-87) and Title 30 of the Revised Statutes as amended and supplemented by the Rooming and Boarding House Act of 1979 ( P.L. 1979, c. 496, effective September 1, 1980), Sections 34, 35 and 36, except for Subsection (d)4. Section 35(d)4 pertains to the provision of mental health and developmentally disabled services.

(c) The Division of Family Development is thus specifically authorized and directed to assist and supervise the county welfare agencies in their provision of services to eligible residents of rooming houses, boarding houses and residential health care facilities.
