(a) A person driving a commercial motor vehicle in interstate commerce, as or on behalf of a motor carrier, shall be at least 21 years of age.

(b) Notwithstanding (a) above, pursuant to RSA 21-P:18, a person may drive a commercial motor vehicle in intrastate commerce carrying home heating oil for the purpose of making retail deliveries if they are at least 18 years of age on or before January 1, 2011.

(c) Notwithstanding (a) above, a person driving a commercial motor vehicle in intrastate commerce as or on behalf of a motor carrier, carrying items other than hazardous materials, hazardous substances, or hazardous waste, shall be at least 18 years of age.
