(a) Pursuant to
RSA
261:89, an initial or vanity registration
plate shall be issued in lieu of the classifications listed in (b) below,
provided that the applicant has complied with the requirements of Saf-C 508 and
paragraph (c) below.
(b) Initial or
vanity plates shall be available for the following classifications, pursuant to
(a) above:
(1) Passenger plates;
(2) Commercial plates;
(3) Antique plates;
(4) Motorcycle plates;
(5) Veteran's plates, to include disabled
veteran's plates;
(6) Trailer
plates;
(7) Street rod
plates;
(8) Walking disability
plates, including motorcycle plates;
(9) Purple heart plates, including motorcycle
plates;
(10) Apportioned
plates;
(11) National Guard
plates;
(12) Active duty military
plates;
(13) Conservation
plates;
(14) State park plates;
(15) Conservation park
plates;
(16) Disabled veteran
motorcycle plates;
(17) Decal
plates; and
(18) Veteran decal
plates.
(c) An initial or
vanity registration plate shall not:
(1)
Include a zero;
(2) According to
the plain and ordinary meaning of the characters on the vanity registration
plate, expressly refers to or is commonly associated with any of the following
subjects, in any language, whether read forward, backward, by mirror image or
by phonetic spelling:
a. Intimate body parts
or genitals;
b. Profane or vulgar
sexual or excretory acts or functions;
c. Words or terms of profanity or
obscenity;
d. Advocating
violence;
e. Illegal
activities;
f. Illegal drugs or
intoxicants;
g. Gangs; or
h. Racial, ethnic, religious, gender or,
sexual orientation slur, discrimination, genocide, hatred, or
bigotry;
(3) Have more
than 7 characters;
(4) Have more
than 2 ampersands, plus signs, or minus signs, and which shall not be
consecutive, such as &&;
(5) Have any characters other than
ampersands, numerals, plus signs, minus signs, or letters;
(6) Have only numerals or only numerals and
ampersands, plus signs, or minus signs; and
(7) Have characters or combinations of
characters which may cause difficulty of distinction or
identification.
(d) The
director or designee shall recall any initial or vanity registration plate that
has been issued which does not conform with the requirements of (c) above,
regardless of when the plate was originally issued, as follows:
(1) The director shall notify in writing any
person whose initial or vanity registration plate is being recalled. The
notification shall identify the non-conformity of the plate and explain the
procedure for obtaining another plate;
(2) Any person whose initial or vanity
registration plate has been recalled shall elect to receive either a refund or
a credit of the special vanity plate service fee for the prorated remaining
registration period; and
(3) Upon
the surrender of an initial or vanity registration plate that has been
recalled, or 30 days after notification as noted in (d)(1) above, the temporary
vanity plate shall be invalidated, and the applicant shall receive a number
plate of the same classification type for the remaining registration period at
no additional cost.
(e) A
person whose initial or vanity registration plate has been recalled may submit
a written request to the director setting forth a detailed explanation as to
the reasons why such an initial or vanity registration plate should be issued.
The director's decision shall be final.
