(a) Upon receipt of a permit application, the commissioner shall consider the following when determining whether to approve or deny a permit:

(1) The size of the public water;

(2) Boating traffic volume;

(3) Type(s) of boating permitted on the public water;

(4) Depth of the public water;

(5) Any underwater obstacles that present dangers to participants in the water event;

(6) Swim areas, rafts and beaches located near the proposed water event;

(7) Any speed or horsepower restrictions on the public water;

(8) Any restrictions set forth in Saf-C 5100 or Saf-C 403 through Saf-C 408 regarding the ecology or environment of the public water; and

(9) Accident statistics for the public water, if any.

(b) After considering the factors set forth in (a) above, the commissioner shall approve the permit application if he determines that in doing so the water event will not jeopardize:

(1) Public safety;

(2) The environment or water quality; or

(3) Threatened and endangered species.

(c) Upon approval, the commissioner shall sign and date the permit application and forward it to the applicant.
