(a) The commissioner shall mail a notice of hearing to the first named petitioner who signed the petition pursuant to RSA 270:74-a. The first named petitioner shall notify the other named petitioners and the town or city clerk(s) of any town or city where the lake, pond or river is located. If the first named petitioner wishes to submit a report to the commissioner, he or she shall do so prior to or at the scheduled public hearing.

(b) The commissioner shall inform the general public of any hearing to be held pursuant to RSA 270:74-a. Such means shall include the distribution of press releases to print and electronic media.

(c) The notice of hearing required in (a) above shall, absent unusual circumstances, be mailed no later than 10 calendar days prior to the date of the hearing.

(d) For the purposes of (c) above, "unusual circumstances" shall include but not be limited to:

(1) A specific feature of a lake, pond or river that requires an immediate response;

(2) An immediate safety hazard; or

(3) Receipt of multiple petitions for a lake, pond or river in which one hearing would be sufficient for all petitioners.
