Section Saf-C 411.01 - Form of Petition

(a) Any petition pursuant to RSA 270:74-a shall be in writing.

(b) A petition, pursuant to (a) above, shall contain the following:

(1) The signatures of 10 or more residents or property owners in the town or towns where the subject lake, pond or river is located;

(2) The printed or typed name, street, mailing address and telephone number of each of the petitioners;

(3) The name and location of the lake, pond, or river for which the hearing is requested; and

(4) The specific relief, either total closure or specific restrictions, being requested.

(c) Unless otherwise specifically stated by the petitioners, the first named petitioner shall be the agent of the petitioners for all purposes relating to the petition and the hearing.

(d) The agent of the petitioners shall have the following responsibilities, including:

(1) Providing information concerning the hearing to other residents or property owners in the town or towns where the lake, pond or river is located;

(2) Assisting the department in locating a building where the public hearing may be held; and

(3) Responding to press inquiries.

(e) All petitions pursuant to RSA 270:74-a shall be submitted to:

(f) The commissioner shall accept amendments to the petition pursuant to RSA 270:74-a, when offered by the original petitioners. Said amendments shall be accepted at any time prior to the close of any hearing held pursuant to RSA 270:74-a or extension thereof, unless the commissioner determines that the amendment enlarges the scope of the hearing. If an amendment to a petition enlarges the scope of the hearing, the scheduled hearing shall be completed, a decision shall be issued and a new hearing shall be scheduled on the amended petition, if evidence has been submitted that justifies another hearing.
