(a) An applicant for a public mooring permit shall provide the following on DSSS 33:
(1) Name, address, telephone number and
cellular telephone number, if available, of the applicant;
(2) Name, address, telephone number and
cellular telephone number, if available, of the contact person responsible for
the mooring field, if applicable;
(3) Number of moorings requested;
(4) Name of the body of water on which the
proposed mooring field will be located;
(5) The distance from shore to the furthest
mooring in the mooring field;
(6)
Adequate directions for locating the area by both water and land;
(7) A written description of access from
shore;
(8) An executed copy of a
deed or lease of the shorefront property;
(9) A description of the mooring buoys,
including the color, shape, size and material;
(10) Description of the mooring anchors,
including the material used and the weight;
(11) Signature(s) of the person authorized to
sign on behalf of the applicant and date signed;
(12) Percentage of moorings in a public
mooring field that shall be used for a full season;
(13) Five copies of a diagram or plan to
scale that includes the following on an 11" x 17" sheet of paper:
a. The location of all structures placed in
the water within 300 feet from the outer perimeter of the proposed mooring
field, such as but not limited to:
1. Docks,
permanent or seasonal;
2. Personal
watercraft or boat lifts;
3. Other
moorings;
4. Swim lines;
5. Swim rafts;
6. Navigational markers; or
7. Launch ramp;
b. The location of property lines and name
and address of all abutters including tax map and lot numbers;
c.The shore frontage in feet;
d. Scale of measurement;
e. North arrow;
f. The water depth in the area of each
mooring;
g. The location of each
mooring from shore;
h. Distance
between each mooring;
i. Support
facilities, such as, but not limited to:
1.
Dinghy docking;
2. Water taxi
service;
3. Public restroom
facilities;
4. Refuge removal
facilities;
5. Holding tank pump
out facilities;
6. Parking for
automobiles and trailers; and
7.
Docks reserved for use of mooring field users for loading or unloading;
and
j. A location map
suitable for locating shorefront access and mooring(s);
(14) A copy of a certificate of insurance for
comprehensive general liability for all claims of bodily injury, death or
property damage that might result from the maintenance, management or operation
of the mooring field and the amount of coverage;
(15) A statement that the applicant shall
indemnify and hold harmless the state, its officers and employees from all
claims, liabilities or penalties resulting from the acts or omissions of the
applicant in maintaining, managing or operating the mooring field;
(16) Name and address of all abutters,
located within 300 feet of the boundaries of the mooring field; and
(17) A statement certifying that all abutters
to the shorefront property have been notified of the application by certified
mail, return receipt requested, and have been provided copies of the
application and grid map.
