(a) The director or his or her authorized representatives shall issue a defective equipment tag to the operator of any boat found to be in violation of any of the equipment requirements set forth in law or these rules.

(b) Any equipment violation shall be noted on the defective equipment tag and the owner of the boat shall be responsible to immediately correct the violation and have the correction verified by the signature of a marina dealer employee or the director or his or her designee. The owner's copy of the defective equipment tag shall be returned to the New Hampshire department of safety, division of safety services, marine patrol bureau, within 48 hours of having the equipment violation corrected and verified.

(c) The issuance of a defective equipment tag shall prohibit the continued operation of the boat until the equipment violation is corrected.
