(a) Any vessel carrying passengers for hire as a common carrier of passengers or property operating on a regular schedule shall carry an approved adult type I life preserver for each person on board. In addition, unless the service is such that children are never carried, there shall be provided a number of approved life preservers suitable for children equal to at least 10 percent of the total number of persons carried.

(b) When passengers aboard a commercial boat are wearing an approved type I, II, III, or V PFD while underway, the vessel shall be exempt from the carrying requirement set forth in (a) above.
