Section Saf-C 3114.02 - Reporting An Incident

(a) An instructor may report an incident involving drug or alcohol use or possession by a student during any portion of the program to the division.

(b) Pursuant to RSA 263:59, the director shall revoke a driver education student's license, as defined by RSA 259:48, upon receipt of information from the instructor that the student has:

(1) Attended any driver education class(es) or related training under the influence of or in possession of an alcoholic beverage; or

(2) Attended any driver education class(es) or related training under the influence or possession of a controlled drug or a controlled drug analog.

(c) Each student whose license is sought to be revoked pursuant to this section shall be afforded notice and the opportunity for an administrative hearing.

(d) All administrative hearings conducted pursuant to this section shall be in accordance with the provisions of RSA 263:59 and Saf-C 200.
