Section Saf-C 3107.02 - Duties of Instructor

(a) A driver education instructor shall:

(1) Protect students from physical harm by working to maintain a safe and healthy environment free of violence, drugs, alcohol, tobacco, sexual harassment, or other illegal influence;

(2) Provide an environment of mutual respect at all times;

(3) Recognize the constitutional rights and responsibilities of students and provide services without discrimination;

(4) Refrain from using his/her professional position to take personal advantage of students or their parents or guardians;

(5) Respond to calls or inquiries from parents or guardians of students within a reasonable period of time;

(6) Abstain from using obscene, vulgar, or offensive language or gestures when conducting any portion of a driver education program;

(7) Abstain from eating, except where medically necessary, or smoking when conducting any portion of a driver education program; and

(8) Abstain from using a cellular phone when conducting any portion of a driver education program, except in the event of an emergency.

(b) The requirements of (a)(7) above shall not apply to instructors during breaks.
