Section Saf-C 1809.02 - Serious Traffic Violations

(a) For the purposes of RSA 259:98-a, the following convictions shall be considered serious traffic violations:
(1)
Excessive speeding, pursuant to
RSA
265:60, involving any single offense for any
speed of 15 miles per hour or more above the posted speed limit;
(2) Reckless driving, pursuant to
RSA
265:79, including, but not limited to,
offenses for driving a commercial motor vehicle in willful or wanton disregard
for the safety of persons or property;
(3) Improper or erratic lane changes,
pursuant to RSA
265:24,
RSA
265:44, and
RSA
265:45;
(4) Following too closely, pursuant to
RSA
265:25;
(5) Driving without having obtained a
commercial driver license;
(6)
Driving without having a valid commercial driver license in
possession;
(7) Any violation of
state traffic laws arising in connection with a fatal accident;
(8) Driving a CMV without the proper class of
CDL and/or endorsements for the specific vehicle group being operated or for
the passengers or type of cargo being transported; and
(9) Any violation of
RSA
265:105-a. For purposes of this subparagraph
only a violation shall not include operating a commercial motor vehicle when
the driver has moved the vehicle to the side of, or off, a highway and has
halted in a location where the vehicle can safely remain stationary.
