(a) The commission shall set the amount of the required fee for participation in the tuition guaranty trust fund. This fee shall be reviewed and adjusted on an annual basis by the commission based upon the amount of money being collected and expended, current economic conditions, and the operating level of the fund.

(b) Each school applying or renewing their license shall pay the annual fee required with their application submittal.

(c) A fine shall be assessed for each 30-day period or portion thereof that payment is late.

(d) An existing license shall be revoked if an application is more than 90 days late.

(e) The annual fee for this fund shall be based on a percentage of gross tuition, but shall not exceed 1% of the annual gross tuition.

(f) "Gross tuition" means the total amount collected by the school during its most recently completed fiscal year, net of refunds, for tuition, application fees, and registration fees.

(g) For schools which are located outside of New Hampshire, and which do not maintain branch campuses or satellite instructional programs in New Hampshire, fees shall be based on gross tuition for New Hampshire students only.

(h) If a school has not operated for a full year, its fee shall be initially based on estimated gross tuition for the first twelve months of operation. At the conclusion of the first 12 months, the fee shall be adjusted to reflect actual gross tuition for the 12-month period. If the adjustment results in a reduction of the fee, the amount to be credited shall be applied to the fee for the following year.
