Section Pos 102.01 - Duties and Powers of the Commission

The commission:

(a) Pursuant to RSA 188-D:1, conducts studies of postsecondary education in the state and prepares and keeps current plans designed to:

(1) Avoid duplication; and

(2) Make effective use of the state's resources.

(b) Reviews the plans for incorporation of any proposed institution of higher education and approves or disapproves of such plans pursuant to RSA 292:8-c - f.

(c) Advises the legislature concerning planning and coordinating higher education including the granting of degrees pursuant to RSA 188-D:8, I.

(d) Specifies the degrees an institution shall grant.

(e) Renews, for a set term of years, degree-granting authority granted by the legislature, except those institutions exempted by RSA 292:8-h, I pursuant to RSA 292:8-b, III.

(f) Conducts periodic re-evaluations of educational institutions under its jurisdiction pursuant to RSA 292:8-ff, I.

(g) Conducts special re-evaluations of any educational institution under its jurisdiction if:

(1) The institution is:
a.Sold;

b.Transferred to; or

c.Merged with another entity.

(2) There is, pursuant to RSA 292:8-ff, II, a substantial change in the governance of the institution including, but not limited to the following:
a.A 50% change in the composition of the governing board within a one year period;

b.Changes in the operational procedures of the board which would affect the mission, character, or quality of the institution; or

c.The board is replaced or subsumed by another governing body.

(h) Suspends or revokes the degree-granting authority of any institution which no longer meets the standards established by rules under RSA 188-D:8-a pursuant to RSA 292:8-ff, III.

(i) Evaluates the plans of any institution which has not conducted regular instruction for 3 consecutive years and whose charter has not been repealed in the same manner, as required by RSA 292:8-f, before that institution can announce a resumption of instruction.

(j) Evaluates a particular degree which any institution has not awarded for 4 years prior to renewed awarding of that degree pursuant to RSA 292:8-ff, V.

(k) Exercises authority over branches of out-of-state institutions operating in New Hampshire. Plans for such branch, branches or extension courses are required to be submitted to the commission for approval prior to being offered pursuant to RSA 186:13-b.

(l) Works with the New Hampshire members of the New England board of higher education and of other interstate agencies, as funding and staff permits pursuant to RSA 188-D:8, III.

(m) Assumes responsibilities allocated to it under Public Law 92-318 and other federal programs within its jurisdiction pursuant to RSA 188-D:8, VII.

(n) Preserves the academic records of institutions of higher education, which either temporarily or permanently cease instruction, whether or not the corporation is dissolved, and provides transcripts of such academic records as requested pursuant to RSA 292:8-kk.

(o) Regulates private trade, commercial, correspondence schools and correspondence school representatives pursuant to RSA 188- D:19-28.

(p) Appoints an ad hoc hearings board which holds hearings and makes recommendations to the commission.
