(a) This section shall apply to:
(1) Any proceeding to determine whether to
impose sanctions, including suspension, revocation, refusal to renew, and
imposition of administrative fines, based on conduct for which a licensee has
been disciplined in another jurisdiction; and
(2) Any proceeding to determine whether to
deny a license application based on conduct that resulted in another
jurisdiction denying a license to an applicant.
(b) In a proceeding that is subject to this section, the licensee or applicant, as applicable, shall bear the burden of persuasion by a preponderance of the evidence that the individual's conduct in another jurisdiction does not constitute grounds to impose sanctions or deny licensure, as applicable, in New Hampshire.
