(a) A petition for declaratory ruling shall contain:
(1) The name and mailing address of
the petitioner and, if the petitioner is filing electronically or is filing on
paper but agrees to receive the notice under Plc 210.04(b) and a response by
email, the email address to which the notice and response should be
sent;
(2) The exact ruling being
requested;
(3) Each statutory and
factual basis for the ruling, set forth in separately numbered paragraphs;
and
(4) Any supporting affidavits
or memoranda of law.
(b) The petition shall be signed by the individual(s) submitting the petition or, if the petition is filed on behalf of an entity, by a duly-authorized representative of the entity, provided that if the petition is filed electronically, the act of submitting the petition shall constitute a signature.
(c) The signature(s) shall constitute a certification that:
(1)
The signer has read the petition;
(2) The signer is authorized to file the
petition;
(3) To the best of the
signer's knowledge and belief, there are good grounds to support the petition;
and
(4) The petition has not been
filed for purposes of delay or harassment in any pending or contemplated
administrative, civil, or criminal proceeding.
