Section Per 405.02 - Disqualification of Applicantsor Candidates

(a) The director or his or her designee shall refuse to certify an applicant, or shall disqualify a candidate, for any one or more of the following reasons:
(1) Based upon the review conducted under Per 405.01, it is determined that the applicant or candidate lacks any of the
requirements for the position for which the application is made;
(2) The applicant or candidate has made a
false statement, misrepresentation or material omission of fact in the
application;
(3) The applicant or
candidate has used or attempted to use bribery or threats to secure an
advantage in the certification review process;
(4) The applicant or candidate has failed to
submit a completed application within the prescribed time limits, unless
precluded from completing the application due to circumstances beyond the
applicant's or candidate's control, such as hospitalization, death in the
family, natural disaster, failure of state electronic systems, or similar
reason outside the control of the applicant or candidate;
(5) The applicant or candidate advocates the
overthrow of the government by unconstitutional or violent means;
(6) The applicant or candidate does not have
a legal right to accept employment in the United States;
(7) The minimum qualifications for the class
have been revised and the applicant or candidate can no longer be certified;
or
(8) The applicant or candidate
has a criminal conviction which has not been annulled or expunged and which is
related to duties and responsibilities which the individual may undertake if
hired for the position.
(b) The director or his or her designee shall provide the applicant or candidate with a written notice stating the grounds for disqualification.
