Section Mid 404.02 - Misconduct

(a) Pursuant to RSA 326-D:8, II, misconduct shall be:
(1) The practice of fraud or deceit in
procuring or attempting to procure certification;
(2) Conviction of any crime demonstrating
unfitness to practice midwifery, as further set forth in (b) below;
(3) Demonstrable gross incompetence of the
certificate holder, as evidenced by a violation of Mid 500 resulting in harm to
the mother, the fetus, or the newborn;
(4) Addiction to the use of alcohol or other
habit-forming drugs to a degree which renders the certificate holder unfit to
practice;
(5) A legal finding of
mental incompetence;
(6) Willful or
repeated violation of RSA 326-D; and
(7) Suspension or revocation without
subsequent reinstatement of certification in another jurisdiction.
(b) Crimes demonstrating unfitness to practice midwifery shall be crimes involving theft, injury to others, physical, or emotional exploitation of others and violence towards others.
