Section Lab 804.02 - Application for Sub-Minimum Wage Rate

(a) No employer shall employ a person whose earning capacity is impaired by physical or mental disability at an hourly rate lower than set forth in RSA 279:21, I without having first secured a special authorization under RSA 279:22 and these rules.

(b) An applicant for special authorization shall supply the following information on/or attached to the "application for employment of disabled person" form:

(1) Name and address of the disabled person;

(2) Name, address and telephone number of employer;

(3) A brief description of the disability;

(4) Medical records describing the disability;

(5) The description of the position that the disabled person will be employed in;

(6) The requested sub-minimum rate;

(7) The date that the employment is to begin;

(8) The date that the authorization is to expire;

(9) The date the application is submitted to the department;

(10) The signature and title of the applicant and telephone number; and

(11) The signature of the employee/disabled person;

(c) The records provided pursuant to (b)(4), above shall be signed by a licensed medical doctor or a professional with medical knowledge of the disability.
