(a) Upon the filing of such motion for rehearing, the panel shall within 10 calendar days either grant or deny the same, or suspend the order or decision complained of pending further consideration.
(b) A motion for rehearing shall be granted only if:
(1)
Evidence is presented with the motion for rehearing which was not available at
the time of hearing which the panel determines would change the decision
rendered;
(2) The party making the
motion for rehearing demonstrates the panel was in error concerning the
interpretation or application of the applicable state statue or administrative
rule; or
(3) The party making the
motion for rehearing demonstrates the decision is contrary to controlling
law.
