Section Lab 1508.05 - Notice of Proposed Fine: Contents

To initiate an administrative fine proceeding, the department of labor shall notify the respondent in writing of the following:

(a) The violation(s) alleged by the department and the facts on which the allegations are based;

(b) The statute that authorizes the commissioner to impose a fine;

(c) The statutory section(s) or rule(s) that specify the amount of the fine and the amount of the fine specified therein;

(d) The total amount of fine(s) being sought;

(e) That the respondent has a right to a hearing prior to the imposition of the fine; and

(f) That the respondent is required to respond to the notice by the date specified in the notice.
