Section Ins 208.02 - Petition for Hearing

(a) In the event of a dispute between a health care provider and an insurance carrier relative to the reasonable value of a service under RSA 329:31-b, either the provider or the insurance carrier may petition for a hearing under RSA 400-A:17 and Ins 208.
(b) The petitioner shall file an original and 2 copies of the petition, and the petition shall set forth the following information:
(1) The rate the
petitioning party believes is commercially reasonable;
(2) The evidence and methodology for
asserting that the fee is reasonable;
(3) The relevant facts relating to the
billing code used;
(4) The efforts
made by the parties to resolve the dispute prior to petitioning the
commissioner for review, including a statement of whether the parties have
engaged in mediation; and
(5) A
certification that the other party and the data analytics division of the
Insurance Department has been served with the petition.
(c) Any petition which does not contain the information required in (b) above shall be inadequate.
